As Terry Anderson Would Have Asked His Radio Audience: ‘Are You Mad’ Yet?

CAPS — Years ago, I was speaking with my friend Terry Anderson, who hosted a popular Los Angeles-based, Sunday night radio show that dealt exclusively with illegal immigration. “If you ain’t mad, you ain’t paying attention” was his tagline. Watch Terry’s two-part interview with CAPS here and here.

Toward the end of our conversation, Terry said: “It’s over for us.” What Terry meant was that California’s illegal immigrant population had grown so fast that the best interests of black Americans like him had, in the political scheme of things, become secondary to those of illegal immigrants.

In South Central, where Terry lived, evidence of illegal immigrants’ ever-growing presence – he called it the “vast influx” – was painfully obvious. As more illegal immigrants moved into the greater Los Angeles area, congressional districts that had elected black officials became Hispanic-dominated. U.S. Rep. Maxine Waters’ South Central 43rd Congressional District, for example, includes the Hispanic-majority cities of Gardena, Inglewood and Hawthorne. To get re-elected, Waters and others in Congress facing the same shifting demographic electorate prioritized Hispanic issues. Waters is good at getting re-elected; she’s been in the House for 25 years!

Terry died in 2010, a few years before Los Angeles County had more Latino residents than any other county nationwide. Rarely a day goes by that I don’t think of Terry fondly, and remember his valiant efforts to raise the awareness of his national audience about illegal immigration’s scourge. I miss Terry, but am comforted by knowing that at least he didn’t live long enough to have read last week’s scandalous story that the University of California Merced now has enrolled more illegal alien students than blacks. According to a Daily Wire headline story, during the spring of 2016, UC Merced provided 303 illegal immigrants with financial aid, teaching jobs and legal services. Black enrollment is 272. The story also notes that 48.5 percent of UC Merced’s student body is Hispanic.

The University of California is a land-grant college built to make higher education more widely available and more affordable for instate students, and has been funded by generations of California’s taxpayers that include Terry and his family. Illegal immigrants should not receive benefits from UC Merced or any other U.S. university unless similar benefits are provided to citizen students. From 8 U.S. Code § 1623, “an alien who is not lawfully present in the United States shall not be eligible on the basis of residence within a State… for any postsecondary education benefit unless a citizen or national of the United States is eligible for such a benefit.”

In Terry’s memory, let me make clear that I’ve been paying attention and that I am mad. To help spread what Terry called the “popular rage,” join the CAPS Action Alert team here to send free messages to the White House and Congress to insist that American interests must come first.

Disgraced Immigration Boss Nominated for ‘Valor’ Award for Calming Employees Amid Terror Attack

FOX NEWS — A U.S. immigration official accused in a federal report of hindering law enforcement agents seeking a suspect in the San Bernardino terror attack and then lying about it has been nominated for a prestigious award – for telling her employees to stay calm and fetching one who was eating lunch in his car. reported in June that Irene Martin, who heads the San Bernardino U.S. Citizenship and Immigration Services office, had been nominated for the Department of Homeland Security “Award for Valor.” But the department refused to say what Martin had done to earn consideration for an award previously given to government employees who saved people from sinking ships and burning cars and confronted gun-wielding criminals.

The answer was only revealed through a Freedom of Information Act request. As the Dec. 2, 2015, attack unfolded a mile and a half away, Martin “warned [her] employees to be very careful and to be vigil (sic) about their surroundings,” according to the nominating petition.

Irene Martin, the US Citizenship and Immigration Services field boss who clashed with federal law enforcement agents, is shown here in file photo greeting Spc. Brent Kiley, of the US Army’s 11th Armored Cavalry Regiment. ( Sgt. Giancarlo Casem/Defense Video & Imagery Distribution System)

When Martin learned that one member of her staff was sitting in his car after returning from lunch, a security guard refused to go and get him, saying the office was under lockdown.

Border Patrol Erecting New Fence in Unwalled New Mexico Area

FOX NEWS — SUNLAND PARK, N.M. – Amid a debate over erecting a new border wall along the U.S.-Mexico border, the U.S. Border Patrol said it is finishing an 18-foot-tall steel fence in the last stretch of unwalled, urban borderline in New Mexico.

Officials said the new fencing will run a mile from the bottom of a mesa to the base of tourist attraction of Mount Cristo Rey, the Albuquerque Journal reported.

Currently, a run-down, 10-foot-high chain-link fence sits in the area and border patrol agents say it can be easily climbed and offers little protection in the city of Sunland Park. The city sits just west of El Paso, Texas and Ciudad Juarez, Mexico.

The new fence will be made of rust-colored steel columns and is part of an $11 million project authorized by the Bush Administration, the Secure Fence Act of 2006. It will supplant the chain link fencing erected in the 1980s. The new barrier will be reinforced 5 feet underground with steel panels to prevent smugglers from building underground tunnels.

“It’s a fence that is replacing another fence,” Border Patrol spokesman Ramiro Cordero said. “It doesn’t hold anymore.”

Slavery in the USA? Mexican Immigrant Forced Illegals to Work Without Pay for 14 Yrs

BREITBART — A Mexican woman living in Texas has been convicted of labor trafficking two women she brought illegally to the United States from Mexico and forcing them to work for her, without pay, for about 14 years.

According to the Justice Department, late Friday a federal jury convicted Olga Sandra Murra aka “Olga Sandra Capon-Meneses”— a 64 year-old woman who immigrated to the U.S from Mexico in 1997 — on two counts of forced labor and two counts of harboring an illegal alien.

Prosecutors explained how Murra illegally brought “V.R.” — a Mexican woman in her 30s — with her when she first moved to the U.S. and a year later, in 1998, arranged for another Mexican woman, “I.G.” to be illegally brought to the U.S. as well.

Murra kept the women from 1997 and 1998 to April 2011 — holding one or both of them and their identification documents — in El Paso and Fort Worth, where she used V.R. and I.G. as employees in her housecleaning business.

The Justice Department said that Murra forced the women to clean three to four houses a day. When they received pay for the work, Murra confiscated it. V.R. and I.G. were also required to clean Murra’s personal residence and prepare her meals.

In holding them, Murra sought to convince I.G. and V.R. that she was a voice of God, requiring the pair to listen to recordings of her reading and explaining the meaning different Bible verses as they worked.

Pro-Illegal Immigration Group Demands Blacklist for Hostile Immigration Judges

DAILY SIGNAL — A group of special interest lawyers who support illegal immigration are pushing the U.S. Department of Justice (DOJ) to produce a list of immigration judges who are hostile to undocumented immigrants.

The American Immigration Lawyers Association filed a Freedom of Information Act (FOIA) request with DOJ, asking them to produce a list of all ethics and discrimination complaints brought against immigration judges; now, the U.S. Circuit Court of Appeals for the District of Columbia has authorized publication of the information.

Bush-era Attorney General Alberto Gonzalez began assessing conduct at the Executive Office for Immigration Review in 2006, when he instituted new training and evaluation procedures for all immigration judges, who are career DOJ employees. That work was continued in 2010 by Attorney General Eric Holder, who established a database for tracking complaints against immigration judges. Complaints may be brought for inappropriate or discriminatory conduct inside or outside of the workplace. Non-frivolous complaints are adjudicated by the Office of the Chief Immigration Judge, which determines what disciplinary action, if any, is merited.

AILA asked the Department to release all complaints filed against immigration judges, and all records concerning the resolution of said complaints, according to the FOIA request. DOJ furnished the Association with over 16,000 pages of information, but redacted information it believed to be exempt from FOIA disclosure, including the names of immigration judges. In place of a name, DOJ provided a three digit code to identify the judge subject to a complaint. DOJ lawyers argue that the names of the judges are beyond the reach of FOIA, since such release would infringe their right to privacy.

A three judge panel of the U.S. Circuit Court of Appeals for the District, found in favor of ALIA, ruling that the names of serial offenders ought to be made public. The D.C. Circuit did qualify the ruling, finding that retired immigration judges, or judges with a small number of complaints, may assert a legitimate privacy interest and avoid the disclosure.

“By enabling the public to make such connections, knowing the identity of that judge could shed considerably more light on what the government is up to,” the court’s ruling reads.

“The court’s decision recognizes the significant public interest in learning about complaints against immigration judges, particularly where the complaints concern on-the-bench conduct and judges who are repeat offenders,” said Julie Murray, lead counsel for the Association.

Repeat-offenders on the immigration bench will be identified, pending the outcome of proceedings in the lower court, though the D.C. Circuit’s ruling makes their publication a near certainty.

Obama Adds One More Amnesty to the List

CIS — The Obama administration continues to broaden the list of immigration laws which they will not enforce, with the publication of a final rule expanding those eligible for the existing provisional waiver process. Illegal aliens who marry green-card holders or have parents in the U.S. can now escape the penalties for illegal presence in the U.S. as a result of this latest usurping of the legislative role by U.S. Citizenship and Immigration Services.

This new provisional waiver process amnesty is one of a long list of Obama amnesties, including: limiting workplace enforcement raids, exempting students who came to the U.S. as children from deportation proceedings, and not deporting any illegal alien who has not been convicted of a serious criminal offense.

Just days before this final rule was rolled out, Obama expanded the amnesty program which flies unlawful Central American Minors (CAM) to the U.S. from Central America. Now the program, never funded by Congress, will also pay to fly entire families and those claiming to be a caregiver of an unlawful immigrant minor to the U.S. to receive amnesty and eventually citizenship.

Prior to the latest rule change (which goes into effect on August 29, 2016), only immediate relatives of U.S. citizens could apply for provisional waivers prior to leaving the U.S. for immigrant visa processing. The new rule expedites present illegal aliens’ ability to apply for green cards, to compete for jobs with U.S. citizens and legal immigrants, and removes the penalty for illegal presence.

Presently to receive the waiver, the illegal alien must show that if they leave the country the qualifying relative who resides in the U.S. would experience “extreme hardship.” But the meaning of this term may be changing as well; USCIS has announced that new guidance is going to be given in the next few weeks on how the agency will determine “extreme hardship.”

As typical, USCIS declares their intent is “family unity.” But this rule, as with past administrative amnesties, has undermined U.S. law and the deterrent effect for future illegal aliens entering the country.

A Practical Step Toward Dismantling Unlawful Sanctuary Rules

CIS — In a recent blog posting, my colleague Jessica Vaughan highlighted a Department of Justice Office of Inspector General (DOJ OIG) report finding that state and local governments with sanctuary rules are in violation of federal law by prohibiting employees from communicating with Immigration and Customs Enforcement (ICE) agents.

As Vaughan notes, there are over 300 such sanctuary jurisdictions; and when they are states, such as California, they have a spillover effect because of their impact on county and local government practices as well.

Although DOJ OIG only examined a sampling of 10 jurisdictions due to resource limitations, there is little doubt that the remaining governments are also in violation of the law, 8 U.S.C. Section 1373. One of the commonalities DOJ found in these sanctuary rules and ordinances is that they often engage in throwaway language to the effect that communication is prohibited “except as provided by federal law” or the like – but that the language of this “savings clause” is deliberately ineffectual because absolutely no effort is made to ensure employees know that their right to communicate with immigration agents is, in fact, protected by federal law.

Making the violation even more egregious is the fact that many, probably most, of the offending sanctuary jurisdictions receive federal law enforcement funding – including, incredibly, under a program that disburses monies for “cooperating” with the federal government in identifying alien criminals under the State Criminal Alien Assistance Program (SCAAP).

The belated zeal on the part of the Obama Justice Department in ferreting out these hypocrites who take federal funds in one hand while holding up the other in a “no go” signal to the immigration authorities is thanks primarily to the efforts of a single legislator, Rep. John Culberson , chairman of the subcommittee that oversees the Justice Department’s funding.

Now that it has been established that these jurisdictions are in violation of federal law, I’m hoping that Rep. Culberson will push DOJ to force these scofflaws to take remedial action. One form of such remedial action would to requiring them to post notices in relevant areas of the workplace making known the existence of the federal law. Something like this might be appropriate:

Justice Dept. Lawyers Ordered to Take Ethics Classes After Misleading Judge in Amnesty Case

WASHINGTON TIMES — The Justice Department will order all of its civil division lawyers to take an hourlong remedial ethics class, hoping to head off even worse punishment from a federal judge who is furious about the way Obama administration attorneys misled him in the case involving the president’s deportation amnesty.

In a document filed with Judge Andrew Hanen last month and made public Monday, administration attorneys insisted they didn’t mean to mislead the court, but they acknowledged sloppiness and said their own use of technical jargon may have confused the judge.

But the lawyers pleaded with Judge Hanen not to slap any of them with sanctions, saying the errors were the result of groupthink and not attributable to any particular lawyer’s goofs. The lawyers asked the judge to keep in place the 108,000 three-year amnesties issued in defiance of his rulings, saying to punish the illegal immigrants who were improperly granted them “would be unwarranted.”

“We fully recognize that we used flawed phrasing, which is unfortunate and regrettable, and — quite understandably — has been exasperating for this Court. But the imprecision was inadvertent, not the product of an intent to deceive,” the department said in its filing. “We therefore respectfully submit there is no basis for imposing sanctions against any person or entity.”

Benjamin C. Mizer, principal deputy assistant attorney general for the civil division, issued an apology in a separate filing and said he would require the remedial ethics classes.

“On behalf of the Civil Division and the Department of Justice, I apologize to the court for the problems that arose in this case. I am very sorry and deeply regret that we failed to provide clear and precise information to the court,” he wrote.

July BLS Report: ‘Accentuate the Positive, Eliminate the Negative’

CAPS — For skeptics of the monthly Bureau of Labor Statistics jobs report, July provided plenty of fodder. Superficially, the numbers looked good, and were better than predicted: the economy added 255,000 jobs, more than Wall Street’s anticipated 180,000.

But the sub rosa picture is ugly. More than 75 percent of the new jobs are in the service sector, meaning they pay little and include many part-time jobs in the hospitality and health care sectors. Many jobs created in the summer months are, by definition, temporary. Wages increased .08 cents per hour, a figure analysts touted but pro-rated over July’s 34.5 average hours worked translates to $2.76 cents – gross income before applicable taxes!

Furthermore, more than 94 million Americans remain detached from the labor force, 55 million of them in the prime employment years of age 16 to 64. The true U-6 unemployment rate is an unacceptably high 9.7 percent, significantly worse than July’s official, “big lie” 4.9 percent.

Among those fortunate enough to have a job, 25 million are foreign-born. They’re the legal and illegal immigrants that candidates in the presidential and congressional November elections either want more or fewer of. But adding more immigrants to an economy that already has 25 million foreign nationals in the labor market at the same time 94 million Americans are on the sideline doesn’t make any sense.

What’s missing in the great immigration debate that dominates this election cycle is an intelligent discussion about what the effect has been of adding millions of work-authorized immigrants to the economy during the last two decades. Under the George W. Bush and Barack Obama immigration-friendly administrations, there are 14 million more American-born citizens not employed since the year 2000. More hurtful to unemployed and under-employed Americans, since Obama took office, the population of working-age foreign-born residents has increased by 6 million and those with jobs has grown by 4.5 million.

The pro-immigration argument claims that adding tens of millions of overseas workers grows the economy. On its face, the statement is true, but more immigration doesn’t improve American lives. Research by Harvard economist George Borjas found high immigration mainly benefits the immigrants themselves and redistributes wealth from American workers to the elites that profit from cheap labor.

Pledges to pass comprehensive immigration reform or to increase refugee resettlement must include an analysis of how adding still more employment-authorized foreign nationals would help struggling Americans (it wouldn’t).

Clinton Promises Amnesty if Hispanics Help

FOX — Washington – Democratic presidential candidate Hillary Clinton promised Friday an immigration reform that offers the quickest possible path to citizenship if she wins the November election and Hispanics cast votes that enable her party to control the Senate.

During a speech in Washington at a conference of the National Association of Black Journalists and the National Association of Hispanic Journalists (NABJ-NAHJ), Clinton said “we have a Republican nominee who has been virulently anti-immigrant,” for which reason she hoped results of the upcoming election will sent a clear message to Republicans that it’s time to stop blocking immigration reform.

Clinton asked Hispanics to get out the vote next November and elect lawmakers who support immigration reform, so that control of the Senate goes from Republican to Democratic.

That and an increase in the number of seats in the House of Representatives will enable the passing of a bipartisan immigration reform, the ex-secretary of state said.

Clinton, who answered questions from the press, something she has not regularly done during the campaign, said she will begin to work “immediately” for immigration reform if she is elected to the White House.

The Democratic hopeful also said she believes that Republicans realize the importance of winning Hispanic votes, but the nomination of Donald Trump as their presidential candidate could derail any such attempts.

Clinton said she takes seriously the interests of Hispanic voters, for whom she promised investments to improve job opportunities and increase the possibilities of success for entrepreneurs.

The Democratic leader also promised to close immigrant detention centers run by private companies and to study in depth the policy of deportations so it doesn’t affect moms and dads working hard for their future.

The latest polls in the U.S. show Clinton extending her lead over Trump, who has never achieved majority support either from Latinos or African Americans. EFE

ICE Union Head Savages Paul Ryan on Out-of-Control Illegal Immigration

BREITBART — House Speaker Paul Ryan is under attack on a new front, after the national union which represents U.S. Immigration and Customs Enforcement officers accused the Speaker of enabling the border crisis.

Chris Crane, president of the National Immigration and Customs Enforcement Council, said the 7,000 officers he represents “wish the speaker of the House would be more vocal in championing an immigration policy that defends the rule of law, and represents the interests of American citizens and lawful residents and protects their safety.”

Crane wrote Ryan deploys rhetoric which “could be adding to that perception” illegals believe they will be allowed to remain in the United States despite breaking the law — and accused Ryan of not caring about the children crossing the border who “are molested and perish.”

The border crisis has been a nightmarish crisis for women and children smuggled illegally into the U.S. “The rape trees are a common practice in this area,” as human trafficking investigator Daniel Walden told Breitbart Texas. “The women are warned in Mexico that they likely will be raped and assaulted during the trafficking process. It is common for mothers to put their young daughters on the pill or some other form of contraception before sending them north. Human trafficking is about the smuggler having power and control over their victims. The rape trees send a signal to those who follow about what will happen if you get out of line. The women are terrorized into submission.”

Such crimes against young women and children could be halted if the U.S. simply enforced its existing immigration law, Crane said.

National Border Patrol Council: Obama’s ‘Era of No Consequences’ Puts America in Peril

CAPS — At a June Federation for American Immigration Reform-sponsored event, I met with many law enforcement offices concerned with the Obama administration’s immigration law-gutting and the consequences that it’s wrought. Border patrol agents and sheriffs alike expressed their frustrations with their inability to do their jobs and to protect the American homeland.

The National Border Patrol Council’s July 28 press release summed up what I heard in person last month from people on the front. After nearly eight years in office, President Obama has conscientiously misled Americans about border security – eight in ten aliens captured at the border are allowed to stay and eventually receive taxpayer-funded benefits. Criminal aliens have flooded local communities and made dangerous drugs like meth and heroin more accessible. The NBPC charged the Obama administration with colluding with special interests to decimate border security and to create what it calls “the Era of No Consequences” for breaking immigration law.

Contrary to what the White House would have Americans believe about immigration and national security, ICE released 80,000 aliens with criminal histories. A Boston Globe investigative journalism story found that 30 percent of those re-released in New England committed new felonies and were charged with rape, child molestation, aggravated assault, armed robbery and attempted murder. The NBPC described these crimes as “Obama’s true legacy on border security.”

Yet, despite Obama’s eight-year history of ignoring the consequences of nonenforcement edicts, NBPC predicts that the worst may be yet to come. The press release told of “a massive influx of activity on our southern border,” and expects that drug cartels and Islamic extremists are eager to take advantage of the porous borders that have developed under Obama.

A Much-Abused U.S. Immigration Program

FRONTPAGE MAGAZINE — A couple of years ago I wrote an article about the scam foisted on Americans by political “leaders” who claimed that all that the United States needs to do to end illegal immigration, is to secure the border that is supposed to separate the United States from Mexico.

In that article, “The ‘Secure Our Border First Act’ Deception: Why it’s no solution to the immigration crisis” I noted that in the Longfellow poem, “The Midnight Ride of Paul Revere” that Paul Revere’s friend had it relatively easy to warn Paul Revere as to how the British would be coming. In fact, with just three lanterns, Paul would be alerted if the British were coming by land or by sea.

Here is the paragraph from that poem that addresses the possibilities:

He said to his friend, — “If the British march
By land or sea from the town to-night,
Hang a lantern aloft in the belfry-arch
      Of the North-Church-tower, as a signal-light, —
      One if by land, and two if by sea;
And I on the opposite shore will be,
Ready to ride and spread the alarm
Through every Middlesex village and farm,
For the country-folk to be up and to arm.”

In that article I listed ten ways for aliens to enter the United States either legally or illegally. Indeed, if we were to seek to hang enough lanterns in a church to warn of all of the possibilities the local hardware store would likely not have enough lanterns to covers all of those possibilities.

Furthermore, lighting all of those lanterns simultaneously would likely cause the Old North Church to catch on fire.

Another Crack in the Veneer of the Government’s Immigration Security Vetting

CIS — Sometimes the most newsworthy items come out in the most unlikely places. The Board of Immigration Appeals (BIA), the appellate tribunal of the immigration courts, has published an opinion sustaining an immigration judge’s decision to continue the detention of one Hussam Fatahi, allegedly a native of Iraq and citizen of Syria. The facts revealed by the opinion prove, once again, just how vulnerable the nation’s immigration security vetting is.

Let me backtrack for a moment though. In October of last year, I wrote a blog post, “Why Syrian Refugee Vetting Will Be Indisputably Fallible”. In that blog, I laid out reasons potential security threats could penetrate screening procedures, including:

Finally, and worst of all, media stories are also replete with articles reflecting the ease with which “migrants”, apparently including jihadists, are able to obtain perfectly legitimate Syrian documents they will ultimately present to interviewing refugee officers from every country, including the United States. This is because many Syrian government offices have been overrun in the chaos of war, leaving their trove of blank documents — passports, national identity cards, driver’s licenses, etc. — behind for extremist groups and criminal gangs to take advantage of.

Not long after that, FBI Director Comey in testimony before Congress asserted his own concerns about the ability of federal agencies to properly vet individuals pouring out of the remnants of that war-torn and jihadist-infiltrated country — despite which the administration trotted out one Department of Homeland Security (DHS) witness after another in later hearings, to assure members of Congress that things couldn’t be better.

Now, thanks to this published BIA opinion, we have proof positive, and it is contrary to all of those assurances. In January 2014, nearly two years before I wrote my blog post, Fatahi (whose identity and nationality are known based solely on what he says—and clearly his word isn’t worth much) used just such a blank Syrian passport, stolen when Islamic State jihadists overran passport production facilities, to enter the United States. How it came into his hands isn’t known. He’s given several equally implausible stories.

Fugitive From Justice Addresses DNC

CAPS — During the last eight years, millions of words have been written and thousands of hours broadcast about illegal immigrants that allegedly live in fear of deportation. Their personal stories in which they cite grave concern about their possible removal have been told and retold.

At the Democratic National Convention, for example, 11-year-old Karla, whose parents are in the U.S. illegally, said that she’s “scared” that at any moment her family could be deported. Ironically, the child’s mother, Francisca, appeared on stage with her. The Department of Homeland Security had issued Francisca a final order of deportation which, when ignored, becomes a felony.

According to immigration law, failure to comply should mean that Immigration and Customs Enforcement would turn Francisca’s file over to its felony unit where she would be considered a fugitive from justice, and subject to arrest at any time. Yet, Francisca had no compunction about appearing on national television before an audience of millions that included DHS officials, other law enforcement agents and high-ranking congressional representatives.

So, I ask: If an illegal immigrant ordered deported can appear on prime time television standing proudly among America’s leaders, how likely is it that approximately 12 million illegal immigrants fear that their deportation is imminent? John Sandweg, former ICE director and a public servant who, based on his professional experience, knows the reality, told the Los Angeles Times that for most nonviolent illegal immigrants the removal probability is “close to zero” and “just not likely to happen.”

If reporters would engage in basic fact-checking from easily accessible government websites, they’d quickly see that Sandweg’s assessment is spot on. An ICE subsection known as Enforcement and Removal Operations (ERO) which has enjoyed a budget increase from $2.75 billion in 2012 to $3.5 billion in 2015 has nevertheless removed 62 percent fewer illegal aliens from the interior during those three years.

The statistics are culled from DHS data provided to the Senate Subcommittee on Immigration and the National Interest. In fiscal year 2012, ICE deported nearly 200,000 illegal immigrants from the interior, but less than 70,000 in fiscal 2015. Keep in mind that the 70,000 represent only the tiniest percentage from of an estimated 12 million illegal immigrant population. As for what happens on the border, the Obama administration now counts individuals returned as deported, administrative sleight of hand that makes the deportation total appear higher than it actually is. Previous presidential administrations tallied removals from the interior and returns from the border as two different categories.

The question of who can and who cannot be removed or returned is so convoluted that ICE Director Sarah Saldana admitted in congressional testimony that she, like her agents, carries an official flashcard that helps identify which illegal aliens are, according to President Obama’s prosecutorial discretion guidelines, the highest priority for deportation. Amazingly, excluded from deportation are criminal aliens found guilty of drunk driving, some sexual abuse offenses and some drug charges. Saldana’s boss, DHS Secretary Jeh Johnson, described Obama’s priority system as “smart.”

In light of government statistics, no intelligent argument can be made that illegal immigrants – “run of the mill” illegal immigrants as Sandweg described them – are truly fearful that they may be subject to deportation. The evidence proves overwhelmingly that an alien who simply blends into society has little if any chance of being targeted for removal.

DHS Provides Online Guide to Skirt Border Enforcement, Evade Detection

POLIZETTE — Obama’s administration now offers a how-to guide for migrants, smugglers or even terrorists to evade the border patrol. The president’s desire rush unassimilated masses through porous borders, no matter the cost, seemingly knows no bounds.

In a stunning display of indifference to the rule of law, Obama’s Department of Homeland Security’s website actually lists the locations in which Border Patrol agents cannot arrest illegal aliens, making it an effective how-to guide for illegal aliens wishing to avoid apprehension.

Needless to say, the brave men and women who put their lives on the line to protect the country from foreign infiltration are less than thrilled. “This continues the march of President Obama for absolute lawlessness,” Pinal County, Arizona Sheriff Paul Babeu told Fox News on Tuesday.

“Not only is there a lack of enforcement or consequences for breaking the law — now he’s provided actual sanctuaries throughout the entire country, not just cities, of no-go places for us in law enforcement to enforce the law.”

It is the sworn duty of the president of the United States to protect and uphold U.S. law, but President Obama’s time in office has been marked by a venomous contempt for U.S. law, especially regarding immigration enforcement.

“This administration has systematically and maliciously attacked and deconstructed all phases of border enforcement,” Dan Stein, president of Federation for American Immigration Reform, told Fox News. “It’s to the point now where virtually nobody has to go home. ICE [Immigration and Customs Enforcement] is no longer carrying out its core mission, of finding, identifying and removing illegal aliens from the country,” he said.

The so-called “sensitive locations” listed by DHS can more accurately be described as sanctuary locations, says Jessica Vaughan, Director of Policy Studies for the Center for Immigration Studies.

“It is mind-boggling that DHS has published a list of what are in effect sanctuary zones for illegal aliens,” Vaughan said. “It is inappropriate for a law enforcement agency to tell lawbreakers where they can go to be safe from enforcement of the laws they broke,” she added.

DHS Chief Sees Signs of Success in Getting Countries to Take Back Illegals

WASHINGTON TIMES — Homeland Security Secretary Jeh Johnson said he’s seen some signs of progress in getting other countries to take their illegal immigrants back when the U.S. tries to deport them, and signaled he’d wait to see how those efforts play out before he’ll commit to stripping visas from those that still refuse.

He’s bucking bipartisan pressure from Capitol Hill where lawmakers, spurred by several high-profile cases, say the U.S. has been woefully reluctant to play hardball with other countries — leaving their criminals on the streets here, where they’ve gone on to kill Americans.

Mr. Johnson, attending a breakfast with reporters hosted by the Christian Science Monitor, also said he’s on track to meet President Obama’s goal of accepting 10,000 Syrian refugees this year, defended his department’s treatment of illegal immigrants from Central America, and said that as long as they aren’t endangering the candidates, his Secret Service agents shouldn’t be policing the press covering presidential campaigns.

He said it’s too early to determine who was responsible for the hack of the Democratic National Committee’s emails, which have embarrassed party officials in recent weeks — but said the growing potential for cybersecurity problems means it may be necessary to designate elections as “critical infrastructure,” which would invoke a more active role for the department in promoting security.

DHS Gives 8,000 Syrian Refugees Temporary Amnesty

TOWNHALL– The Department of Homeland Security is granting some 8,000 Syrian refugees temporary amnesty, according to The Washington Times. DHS Secretary Jeh Johnson said that if these refugees are in the country as of Monday—they’re eligible to permanent resident status, work permits, and other documents that would allow these migrants to remain without fear of deportation This amnesty also applies to Syrian refugees that may have entered the country illegally:

Secretary Jeh Johnson issued “temporary protected status” to Syrians, saying that if they are in the U.S. as of Monday and continue to reside here permanently, they can apply for work permits and other documents to remain and live in the U.S. without fear of being ousted.

His order applies to some 5,800 Syrians who were granted status under the original 2012 TPS program, and 2,500 new arrivals who don’t have a more permanent status here.

“Syria’s lengthy civil conflict has resulted in high levels of food insecurity, limited access to water and medical care, and massive destruction of Syria’s infrastructure. Attacks against civilians, the use of chemical weapons and irregular warfare tactics, as well as forced conscription and use of child soldiers have intensified the humanitarian crisis,” Mr. Johnson said in announcing the new program.

Those eligible for TPS include any Syrian illegal immigrants who have managed to sneak into or remain in the U.S. beyond their visa expirations over the last four years.

Joe wrote earlier today that 2,340 refugees were admitted in July, bringing the total number accepted into the country to a little over 7,500. President Obama promised to resettle 10,000 such refugees last year. The Washington Times added that TPS order run for 18 months. It expires on March 31, 2018. One of the issues regarding the Syrian refugee crisis is the notion that ISIS will embed themselves with these migrants. There’s also the issue of crime and the challenges of cultural assimilation. Norway has to offer seminars to tell Muslim men that rape is not legal or acceptable in the country. In England and Wales, The UK Express reported that around 900 Syrians were arrested in a year for a laundry lis of crimes, some of which included rape and child abuse. The crime issue arose last New Years’ Eve when migrants sexually assaulted some 500 women in Cologne, Germany.

Border Patrol Website Provides Info to Illegals on How and Where to Hide Inside America

FOX NEWS — Immigrants who want to enter the U.S. illegally can learn how and where to avoid the Border Patrol from an advisory on the agency’s own website, which critics say is evidence of the Obama administration’s “schizophrenic” approach to enforcement.

Safety and sanctuary can generally be found at schools, churches, hospitals and protests, where Customs and Border Protection agents are barred under a “sensitive locations policy” from carrying out their duty of enforcing border security. In fact, the agency’s website states that actions at such locations can only be undertaken in an emergency or with a supervisor’s approval.

“The policies are meant to ensure that ICE and CBP officers and agents exercise sound judgment when enforcing federal law at or focused on sensitive locations, to enhance the public understanding and trust, and to ensure that people seeking to participate in activities or utilize services provided at any sensitive location are free to do so, without fear or hesitation,” the government website states in both English and Spanish.

While the explanation is apparently meant to show the deference Customs and Border Protection agents show to sensitive societal institutions, critics, including the Media Research Center, say it also tells illegal border crossers where to go if they are being pursued. Agents are barred from interviewing, searching or arresting suspected illegal immigrants in such locations.

“So, almost any illegal alien can escape arrest by either walking with a second person (a march), attending some type of class, or finding a nearby church, medical facility or school bus stop,” the Center wrote in a post bringing the advisory to light.

DOJ Rewards Law-Breaking Sanctuary Cities, States With $342 Mil in “Grants”

JUDICIAL WATCH — The Obama administration rewards sanctuary states, counties and cities that shield violent illegal immigrants from deportation with hundreds of millions of dollars in federal grants and one of the biggest recipients recently made headlines for protecting a serial criminal who murdered a young woman. The money flows through the Department of Justice (DOJ), the agency responsible for enforcing the law and defending the interests of the United States. The DOJ is also charged with providing federal leadership in preventing and controlling crime, according to its mission statement, and seeking just punishment for those guilty of unlawful behavior.

Apparently this doesn’t apply to local governments that support the president’s broad open borders policies, even when they violate federal law. The DOJ doled out $342,168,401 to 10 sanctuary states and cities that proudly reject federal claims for criminal illegal aliens earmarked for removal, according to the agency’s independent watchdog. Among them is Connecticut, a trailblazer in the sanctuary movement that received more than $69 million in grants from the DOJ. Connecticut has long protected illegal immigrants with sanctuary policies and even offers them special drivers’ licenses, known as Drive Only. The state also gives illegal aliens discounted tuition at public colleges and universities and authorities work hard to restrict the feds from deporting illegal immigrants. Last year an illegal immigrant who had spent 17 years in prison for attempted murder stabbed a 25-year-old woman to death in Norwich, a city of about 40,000 residents. The murderer had been earmarked for deportation at least three times.

California, also a renowned sanctuary state that offers illegal immigrants a number of taxpayer-funded perks, topped the list with $132,409,635 in DOJ grants. Judicial Watch has investigated the state’s illegal sanctuary policies for years and back in 2008 launched a California public records request with the San Francisco Sheriff’s Department to obtain the arrest and booking information on Edwin Ramos, an illegal alien from El Salvador who murdered three innocent American citizens. Ramos was a member of a renowned violent street gang and had been convicted of two felonies as a juvenile (a gang-related assault on a bus passenger and the attempted robbery of a pregnant woman) yet he was allowed to remain in the country. Last year Judicial Watch obtained records showing that violent crime—including murder and rape—in the Bay area has skyrocketed since the San Francisco Sheriff and City Council expanded illegal alien sanctuary policies in 2013. Under the ordinance San Francisco law enforcement agencies are required to ignore most U.S. Immigration and Customs Enforcement (ICE) detainers. Judicial Watch is also investigating whether the city violated the law again with its sanctuary policy that led to the release of Juan Francisco Lopez-Sanchez, an illegal immigrant deported five times who gunned down Kate Steinle at one of the most popular tourist spots in San Francisco.

Hillary Clinton’s Immigration Goals Would Irrevocably Undermine National Security

CAPS — Our nation’s immigration laws are completely blind as to race, religion and ethnicity, and were enacted to protect national security and the lives and livelihoods of Americans.

My previous post for CAPS, “Hillary Clinton’s Immigration Goals Make Her Economic Promises Impossible to Achieve,” focused on how providing potentially tens of millions of illegal aliens with an equal standing in the overflowing labor pool of unemployed or underemployed American and lawful immigrant workers would exacerbate the plight of these desperate workers and their families.

Today my focus will be on how Hillary Clinton’s proposal to provide millions of illegal aliens with lawful status would do irreparable harm to national security and public safety.

Hillary has made much of having been Secretary of State. During her acceptance speech at the DNC she said, in part, “We will not build a wall,” thereby echoing the remarks of her successor at the State Department, John Kerry who, in his commencement address at Northeastern University several months ago, said, in part, that America could not remain great by hiding behind walls.

I recently wrote a commentary about Kerry’s dangerous globalist agenda that apparently is paralleled by Clinton, “John Kerry: Enthusiastic Proponent of a ‘Borderless World.’”

Metaphorically, America’s borders are her walls.

One of the critical roles of the State Department is to issue visas to aliens who seek entry into the United States. The visa process came under scrutiny by the 9/11 Commission. It identified failures in border security and failures of the visa process that enabled the 19 terrorists in the 9/11 hijackings and terrorists who preceded them. Visa fraud was a means to enter the U.S., allowing them to embed themselves in the country as they went about their deadly preparations.

Senator Fears CBP Agent Let Illegal Immigrant Brother Smuggle Drugs

WASHINGTON EXAMINER — Customs and Border Patrol agents keep catching the same drug trafficker on the southern border whose brother happens to be a senior CBP agent, and Senate investigators want to know if the illegal immigrant has been getting special treatment.

The case involves Miguel Angel Padilla Heredia, a Mexican citizen with a history of robbery and drug smuggling who has been arrested repeatedly at the border of Arizona and Mexico. At one point, Padilla tried to claim eligibility for the deferred action policy that President Obama announced in 2012, but he was ordered deported, only to return in December 2013.

Padilla was stopped at a border patrol check point and “allegedly narcotics were discovered in his vehicle,” but he wasn’t deported.

“It is unknown what occurred during this specific interaction, and whether this was the first instance in which Mr. Padilla attempted to smuggle narcotics into the United States,” Senate Homeland Security and Government Affairs Committee Chairman Ron Johnson, R-Wis., wrote in a July 26 letter to Department of Homeland Security Inspector General John Roth.

What is known, however, is that the alleged drug smuggler’s brother, Manuel Padilla, was chief of the Tucson Sector of the U.S. Border Patrol when he was stopped at that checkpoint. The CBP officer is now a chief patrol agent for the Rio Grande Valley Sector.

Johnson wants Roth to investigate the immigrant’s interactions with the Border Patrol to learn more about his most recent stop at the border checkpoint and find out if the border patrol chief had “any influence” on his brother’s case.

“While the committee is not aware of any direct evidence that Chief Patrol Agent Manuel Padilla took any action on behalf of his brother, the fact that his brother allegedly entered the country illegally during the time of Chief Patrol Agent Padilla’s leadership of the Tucson Sector raises concerns,” Johnson wrote to Roth.

Remembering When Democrats Turned Their Backs on American Workers

“Democrats are the party of working people. But we haven’t done a good enough job showing that we get what you’re going through, and that we’re going to do something about it.” –– Hillary Clinton, accepting the Democratic Party’s nomination for president, July 28

CENTER FOR IMMIGRATION STUDIES — Hillary Clinton’s claim that Democrats are “the party of working people” brings to mind the Senate hearing where Ted Kennedy made it clear that on immigration policy they had walked away from that historic trust. I was a reporter at that hearing, and I remember it well.

It was 2006 and Kennedy was urging colleagues on the Judiciary Committee to support comprehensive reform that would not only provide legal status to millions of illegal immigrants but also bring in hundreds of thousands of additional foreign workers annually who would also be given a path to citizenship.

Kennedy and other Democrats were willing to flood low-wage labor markets because that was the price of support from business lobbyists who were expected to attract Republican support. Those lobbyists included representatives of the U.S. Chamber of Commerce, National Association of Manufacturers, the National Restaurant Association, and the American Hotel and Lodging Association.

Kennedy made common cause with the employers whom he normally opposed on such issues as the minimum wage, health care benefits, and the rights of unions to organize workers. But at that 2006 hearing on immigration reform, the liberal lion planted his tongue in his cheek and declared that he had become “the spokesman for the Chamber of Commerce.”

The irony of the hearing doubled when Sen. Jon Kyl, a rock-ribbed conservative and former chairman of the Phoenix Chamber of Commerce, demanded that attention be paid to how the bill would hurt American workers. Kyl predicted that if Kennedy got his way, the next economic downturn would summon the wrath of constituents competing for work with the millions of new guest workers. He noted that the bill would allow the new workers to settle permanently in the United States.

The Trump and Clinton Immigration Plans

CENTER FOR IMMIGRATION STUDIES — Donald Trump took to Twitter last night to respond to Hillary’s speech. Unsurprisingly, the public responded in largest numbers to his tweets referencing immigration. The most popular tweet, which quickly received close to 13,000 retweets and almost 32,000 likes, mentioned Hillary’s push for a 550% increase in refugees while refusing to mention radical Islam. Runners-ups were tweets saying Hillary was “owned” by Wall Street and her vision of “a borderless world where working people have no power, no jobs, no safety.”

The public’s enthusiastic response to these short and specific statements should remind both candidates of the broad spectrum of anxieties that Americans feel regarding the increases in both legal and illegal immigration. Americans legitimately fear the unprecedented large and increasing number of refugees entering the country who cannot be adequately vetted to interdict potential terrorists. Americans also object to the non-stop flow of thousands and thousands of foreigners streaming into the country with leaders unable or unwilling to stop or control the numbers. But security is not the only issue, it’s also jobs, the corporate elite’s financial benefit from immigration to the detriment of poorer Americans, and so much more.

Immigration might well be the political issue that decides the 2016 presidential election. Voters care about immigration – the only public policy issue that impacts all other issues, including national security, crime and community safety, wages and employment, fiscal policy, education, healthcare, the drug epidemic, and the environment. So which presidential candidate advocates policies that keep America safe, help the economy, the American worker and families?

The contrast between the two candidates’ immigration views could not be more distinct. Nowhere has the difference been more apparent than on the stages of the recent national conventions. The Republican National Convention highlighted the rule of law and the impact Americans feel from crime perpetuated by illegal aliens who would not have been in the country if laws were enforced. The parents of those who died at the hands of illegal aliens took the stage and told their stories, pleading that immigration laws be enforced so other families do not suffer the same pain.

The Democrat National Convention brought illegal aliens on stage, highlighting Clinton’s support for an open border and her opposition to the enforcement of federal law. One illegal alien spoke defiantly against Trump for wanting to separate families. Her father came to America, leaving his family, before she and her mother illegally entered to join him. Her point was puzzling since it was her parents who made the decision knowing they were taking a risk by breaking American law and since no one, including Trump, would ever deter them from returning to their homeland together as a family unit.

The candidates’ immigration plans also reveal their contrasting views on the role of immigration to a country and her citizens. Please examine the two immigration plans (see here for Jon Feere’s comparison) – Trumps’ plan to Make America Great Again, which returns time and time again to immigration policy’s role in helping build America and helping citizens and legal immigrants achieve the American dream, and Clinton’s plan for Comprehensive Immigration Reform, which almost exclusively speaks to providing illegal aliens a path to citizenship and allowing their family members the same.

Immigrant Mass Murder Syndrome Update: 556 Killed, Over 1500 Wounded in North America Alone

VDARE — See our updated FAQ “What is Immigrant Mass Murder Syndrome?” which has an extensive list of immigrant Mass Murders.

In Nice, France, a Muslim immigrant truck driver deliberately crashes his truck into a French crowd. In Munich, a “German-Iranian” youth, said by German authorities to be something of mental case rather than a formal terrorist asset, commits a mass shooting of his “fellow” German citizens. Then there’s the guy with the ax in the German train, and the other Muslim guy with the machete.

Those are Muslim crimes, presumably done for Muslim reasons, and there have been many of them committed in the United States by (a) Muslim immigrants, and (b) the “absimilated” children of Muslim immigrants, of whom Omar Mateen is the most recent in the US.

Absimilation, a word coined by John Derbyshire, is the reverse of assimilation. A non-terrorist example of absimilation would be George P. Bush, the son of Jeb and Columba Bush, who famously said (in Spanish, to a gathering of Hispanic Republicans)“ “She [Columba] told me we have to fight for our race, we have to find the leaders who represent us”. (See also George P.’s statements about the Border Patrol here.)

But Immigrant Mass Murder has also been committed by Asians, Africans, Hispanics, and immigrants from the Caribbean. A list I compiled of these killings included killers from Kuwait, Guyana, India, Burma, Somalia, and Vietnam—all in 2015.

What these attacks are is not the kind of international action that George W. Bush tried to solve by invading Afghanistan and Iraq—they’re what calls “Immigrant Mass Murder” and the solution to them is an immigration moratorium.
